This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Gürbüz Uğurgül ("Licensor") regarding the PenaReports application ("Software").

The following terms used in this Agreement shall have the meanings set forth below:
apinews.penareports.com) used solely for delivering application news and announcements.By installing, accessing, or using the Software, you confirm that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you must not use the Software and should immediately delete it from your devices.
The Licensor grants you a non-exclusive, non-transferable, and revocable license to install and use the Software solely for your personal, non-commercial, or internal business purposes.
The ownership and all copyrights, trademarks, patents, and all other intellectual property rights in and to the Software belong exclusively to the Licensor. The Software is licensed, not sold, to you.
The ownership of all reports, processed data, data connection information, and resulting files created by the User using the Software belongs entirely to the User.
The User shall not, and shall not permit any third party to:
The PenaReports application performs its report generation and core data processing functions exclusively on the User's local device. The Licensor does not collect, store, or process User-generated reports, files, or sensitive credentials (PII) from the local device.
The Software connects to the Licensor's API (apinews.penareports.com) solely for the purpose of retrieving application **news** or **static notification data**. The User does not submit any data, personal information, or active search queries to the Licensor's API. Connection data necessary for server maintenance and security (such as IP addresses and timestamps) may be logged by the server; details are provided in the Privacy Policy.

The Licensor's API is a one-way channel used solely to send news and announcements to the User. This API does not deliver or handle any executable code, user data, or application updates. The Licensor is responsible for the security and maintenance of this API.
If the Software allows connection to *other* external Third-Party Services (not controlled by the Licensor, such as a user's corporate database), the User is solely responsible for compliance with the terms of use and policies of those external services.
The Software may include or be distributed with certain components, libraries, and packages ("Third-Party Software") that are subject to separate license terms, including open-source software licenses.
The Software is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, the Licensor provides no warranties, express or implied, regarding the Software's merchantability, fitness for a particular purpose, absence of errors, performance, or uninterrupted operation. The entire risk arising out of the use or performance of the Software remains with the User.
In no event shall the Licensor be liable for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever (including, without limitation, damages for loss of data, faulty report generation, loss of profits, or business interruption) arising out of the use of or inability to use the Software.
The User agrees to indemnify, defend, and hold harmless the Licensor from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) the User’s breach of any term of this Agreement; (ii) the User’s use of the Software; (iii) the User’s reliance on any data or reports generated by the Software; or (iv) the User’s connection to or use of any Third-Party Services through the Software.
This Agreement is effective until terminated by you or the Licensor.
Upon termination, the User must destroy all copies of the Software.
This Agreement shall be governed by and construed in accordance with the laws of the **Republic of Turkey**. The User agrees that any action or proceeding arising out of or related to this Agreement or the Software shall be subject to the exclusive jurisdiction of the courts located in **Istanbul, Turkey** (or the specific jurisdiction in Turkey where the Licensor is registered).
